QAMISHLI, Western Kurdistan, — The individual military judge in Qamishli gave his sentence in the trial of Suleman Osso and his friends on Sunday, 11 July 2010 in case no. 166 of 2010 in relation to sixteen Kurdish people, namely:

• Havand Hussein,
• Ewan Abdullah,
• Masoud Burro,
• Dil Khwaz Darwish,
• Rasho Mikhan,
• Bandawar Sheikheh,
• Dil Khwaz Mohammed,
• Salar Abdul Rahman,
• Riad Hoban,
• Ayman al-Mahmoud,
• Abdul Karim Abdo,
• Riad Ahmed,
• Daham Sheikheh,
• Rashid Othman,
• Swar Sheikheh.

The ruling came in paragraphs, as follows:
1 – Drop public interest litigation against all defendants for the crime of belonging to a banned political association, and inciting riots under Articles 288 and 335 of the Syrian Penal Code because this was included in the latest amnesty no. 22 of 2010.
2 – The following people were found not guilty:
Havand Hussein, Ewan Abdullah, Masoud Burro, Dil Khwaz Darwish, Rasho Mikhan, Bandawar Sheikheh, Swar Sheikheh of offense of inciting sectarian strife provided for in Article 307 of the Syrian Penal code.
3 – The following defendants were criminalised:
Suleman Osso, Abdul Karim Abdo, Salar Abdul Rahman, Dil Khwaz Mohammed, Daham Sheikheh, Riad Ahmed, Ayman al-Mahmoud, Rashid Othman, Riad Hoban, charged with the crime of inciting racial strife provided for in Article 307 of the Syrian Penal Code. The court changed the characteristic of the crime, which was originally sectarian strife to Racial strife, and accordingly sentenced them to six months.
4 – The sentences were reduced from six months to four months in prison
5 – Prevented from taking up office and public functions.
6 – The time in detention would be taken into account
7 – Subject to appeal a decision of revocation was issued on 11 July 2010.
The hearing was attended by members of the defence team of lawyers: Mohamed Khalil, Radwan Seydou, Mahmoud Omar, and Sabri Mirza.
These people were randomly detained in connection with the activities of Newroz, without court order from a competent judicial authority, in the various Kurdish areas in the province of Hasakah. The judge in Qamishli had previously released all of the defendants in the earlier.
Kurdish organization for the defence of human rights and public freedoms in Syria (DAD) condemned the unjust ruling on the right of these citizens. It called upon the Syrian authorities to stop arbitrary detention, and to release all political prisoners and prisoners of opinion and expression; to uphold the freedoms of democracy; and to abolish the State of Emergency and martial law.
DAD also calls for independence of the judiciary, and respect for authority and for the independent international charters and conventions on human rights, so that the Syrian citizen can live in peace, freedom and tranquillity.
